Chowbus Gift Card Terms & Conditions
(Effective June 20th 2025)
1. Definitions
- Merchant – The restaurant or business accepting Chowbus POS and enabled to sell gift cards.
- Card – A non-reloadable, digital gift certificate issued by Merchant in U.S. dollars through the Chowbus platform.
- Purchaser / Holder – The individual who buys or redeems a Card.
- Chowbus – Chowbus Inc. and its payment-processing subsidiaries acting solely as Merchant's service provider.
2. Issuer & Liability
The Merchant is the sole issuer and obligor of the Card. Chowbus acts only as (i) payment facilitator, (ii) stored-value ledger, and (iii) delivery channel. All redemptions constitute direct payment to Merchant. Purchaser agrees that Chowbus has no responsibility for restaurant service, quality, or closure, and that Merchant is solely liable for honoring Card value.
3. Purchase & Delivery
- Cards may be purchased in preset denominations of $1 – $500. There is a minimum amount that you may load on any Merchant Card at any given time, and that amount is typically $1. Chowbus or the Merchant may change any of these amounts at any time without notice to you
- Digital delivery occurs via e-mail/SMS. Chowbus records delivery timestamp and IP for fraud prevention.
- Title and risk of loss pass to Purchaser upon electronic transmission. Chowbus is not responsible for lost, stolen, or deleted Cards.
- You may not have more than $500 in value on any of your Merchant Cards at any time, and no more than $2,000 of activity may be associated with any one Merchant Card in a single day.
4. Redemption
- Redeemable only for food, beverage, taxes and gratuity at participating Merchant locations or online ordering sites that accept Chowbus POS. Gratuity redemption may be excluded by Merchants.
- Not redeemable for cash except where required by law
- No reloads, resales, or transfers for value without Merchant's written consent.
5. Fees & Expiration
- No inactivity or service fees.
- Funds do not expire.
6. Balance & Refunds
- Check balance by scanning the QR code inside the Merchant branded app or requesting it at the point of sale.
- Unused value is non-refundable, except as required by federal or state law or if Merchant ceases operations before the Card is fully redeemed.
- In event of Restaurant closure, Chowbus may, at Merchant's direction, issue a refund or transfer value to another Merchant location.
7. Fraud & Abuse
Merchant and Chowbus reserve the right to (a) reject or cancel any Card obtained by fraud, and (b) debit or freeze a Card balance if evidence of chargebacks, stolen payment credentials, or unauthorized resale appears.
8. Data Privacy
Card purchase data is processed under Chowbus' Privacy Policy and stored in PCI-DSS–compliant environments. Chowbus does not sell consumer PII. Cardholder data may be shared with Merchant solely to fulfill and support the transaction.
9. Limitation of Liability
NEITHER CHOWBUS NOR ITS PAYMENT PROCESSOR SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM OR IN CONNECTION WITH ANY CARD. AGGREGATE LIABILITY, IF ANY, SHALL NOT EXCEED THE UNUSED BALANCE ON THE CARD.
10. Governing Law
These T&C are governed by the laws of the state where Merchant is located. Any dispute between Purchaser and Merchant shall be resolved in the courts of that state. Purchaser consents to such jurisdiction.
11. Amendments
Merchant may amend these terms with 30 days' advance notice posted at the point of sale and on its website. No amendment will retroactively reduce a Card's remaining balance or shorten its validity period.
